The inadequate filling of a package so that it contains too little of the product.

Slack fill is the empty space inside a package that remains unfilled by the product it contains. This gap exists between the product itself and the inner dimensions of the container, measured by volume or depth. A cereal box that is one-third air, a bottle with visible headspace below its cap, or a blister pack with loose product rattling inside all exemplify slack fill.

The distinction matters legally and commercially. Intentional slack fill, where a manufacturer deliberately under-fills a container to reduce product quantity while maintaining the outer package size, constitutes deceptive packaging under the Fair Packaging and Labeling Act (FPLA) in the United States. The regulations permit slack fill only when it serves a functional purpose: protective cushioning for fragile goods, accommodation of product settling during shelf life, provision of headspace for liquid expansion or gas injection, or operational requirements of the filling machinery itself.

Legitimate versus deceptive slack fill

Pharmaceutical tablets, for instance, require headspace to allow safe tamper-evident sealing and to prevent crushing during transit. Frozen foods need air circulation to prevent freezer burn. Cereal manufacturers have genuinely reduced slack fill in recent years by narrowing boxes, but historical practice involved selling the same quantity in visibly larger containers. The difference lies in consumer expectation: if the package clearly displays net weight or volume on the label, slack fill becomes irrelevant to actual value; if the package shape implies a quantity it does not contain, the practice crosses into deception.

Slack fill creates practical problems in warehousing and logistics. Packages with excessive empty space occupy more cubic footage per unit of product, inflating transportation costs and storage requirements. This inefficiency drives manufacturers toward tighter packaging, which in turn reduces protective slack and increases damage rates for sensitive products. The optimization point varies by product category and distribution method.

The term itself emerged from regulatory language aimed at protecting consumers from the illusion of quantity. A package may be legally full while containing slack fill, or it may be honestly marked yet appear deceptively empty to the casual observer. The law focuses on intent and industry practice rather than the absolute absence of air; context determines legality.
